PLEASE READ THE FOLLOWING TERMS CAREFULLY BEFORE USING OUR SERVICES. BY SUBMITTING AN ORDER FOR SUPACOLOR TRANSFERS OR OTHERWISE USING OUR SERVICES, YOU ARE CONSENTING TO BE BOUND BY THESE TERMS AS WELL AS ALL OTHER RULES, POLICIES AND PROCEDURES RELATED TO OUR SERVICES THAT WE MAY PUBLISH FROM TIME TO TIME, AND ARE BECOMING A PARTY TO THIS AGREEMENT. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, DO NOT USE OUR SERVICES.
Supacolor was created with the mission to make high-quality heat transfers so fast and easy that anyone with a heat press can become a professional printer. We streamlined every step of the process, from pricing and placing your orders to receiving your transfers and pressing them on almost any fabric. The result is the most efficient and versatile heat transfer available.
Our Terms, together with the FAQ, were created to assist you with using and accessing our Services.
Terms of Use
Our Terms of Use (“Terms” or “Agreement”) are entered into by and between you, Supacolor, and HeatPressNation.. Supacolor provides a range of services that enable you to order high-quality heat transfers with almost any design of your choice (hereinafter, “Services”). We make our Services available through our website: https://www.heatpressnation.com/.
IF YOU DO NOT UNDERSTAND THIS AGREEMENT, OR DO NOT AGREE TO BE BOUND BY OUR TERMS AND PRIVACY POLICY, DO NOT ACCESS OR USE OUR SERVICES.
By entering into this Agreement, you represent and warrant that you are least 18 years old. If you are entering into these Terms on behalf of legal entity, you represent and warrant that you have the authority to bind this legal entity. IF YOU FAIL TO MEET THESE REQUIREMENTS, YOU MAY NOT ACCESS OR USE OUR SERVICES.
INTELLECTUAL PROPERTY
By using our Services, you represent and warrant that you own, have legally licensed, or have the requisite rights to reproduce all the designs you provide us with (hereinafter, “Content”). You hereby grant us, our websites, and third-party affiliates, a worldwide, royalty-free, nonexclusive, assignable and sublicensable limited license, to manufacture and produce your Content for you through our Services.
YOU ARE SOLELY RESPONSIBLE FOR ALL CONTENT THAT YOU SUBMIT THROUGH OUR SERVICES. YOU REPRESENT AND WARRANT THAT YOU OWN OR HAVE OBTAINED ALL INTELLECTUAL PROPERTY RIGHTS IN YOUR CONTENT, INCLUDING WITHOUT LIMITATION, THE RIGHT TO MANUFACTURE, DISTRIBUTE OR SELL PRODUCTS THAT INCLUDE YOUR CONTENT. Further, you represent and warrant that:
- You provide us with rights as set forth in these Terms;
- Your Content and the manufacture, distribution or sale of products that include your Content does not and will not infringe the intellectual property rights of any person or legal entity, including without limitation any copyright, moral rights, trademark, patent, right of publicity or right of privacy;
- Your Content is free of false, inaccurate, misleading, incomplete, defamatory or libelous obscene, pornographic, indecent, harassing, threatening, harmful, invasive of privacy, in violation of anyone’s rights, including their privacy or publicity rights, abusive, inflammatory or otherwise objectionable materials;
- Your Content is accurate, not misleading or otherwise deceptive.
SUPACOLOR NOR HEATPRESSNATION DOES NOT REVIEW THE CONTENT, AND IS NOT RESPONSIBLE FOR ANY CONTENT MADE AVAILABLE BY YOU THROUGH OUR SERVICES. HOWEVER, SUPACOLOR AND HEATPRESSNATION RESERVES THE RIGHT TO EXAMINE OR EVALUATE THE CONTENT AND TO REFUSE TO COMPLETE OUR SERVICES IF WE DETERMINE THE CONTENT VIOLATES THESE TERMS OR OUR RULES, POLICIES OR PROCEDURES.
You understand that our Services are based on the Content submitted by users that may be in the form of designs, images, pictures, text, photographs, graphics, or other materials submitted, posted, published, displayed through our Services.
IT IS YOUR RESPONSIBILITY TO MAKE SURE THAT YOU ARE FULLFILING YOUR LEGAL RESPONSIBILITIES AND NOT VIOLATING ANYONE’S RIGHTS OR BREAKING ANY APPLICABLE LAWS BY SUBMITTING THE CONTENT THROUGH OUR SERVICES.
As long as you are in compliance with these Terms and our rules, policies and procedures, Supacolor and HeatPressNation grants you a limited, non-exclusive, revocable, non-transferable license, without right of sublicense, to use our Services solely for the purposes intended under these Terms.
IF YOU BELIEVE THAT YOUR WORK HAS BEEN COPIED IN A WAY THAT CONSTITUTES INTELLECTUAL PROPERTY INFRINGEMENT, OR IF YOU SEE ANY INFRINGING CONTENT AVAILABLE THROUGH OUR SERVICES, PLEASE CONTACT US AT SUPPORT@HEATPRESSNATION.COM.
ORDERS
All orders should be made through our Website - http://www.heatpressnation.com. We reserve the right to set quantity limits on any order, to reject all or part of an order, even after you placed the order. We reserve the right to refuse any order in our sole discretion. In addition, before accepting your order, we may require additional information if you have not provided all of the information required to process your order.
You may find all information related to technical requirements of placing an order in the Frequently Asked Questions (“FAQ”). FAQ are incorporated herein by reference.
Payments
Prior to placing an order through our Website, you will need to provide your payment information to us or to any designee we may appoint. Your order information should include all relevant information, including, but not limited to, credit card number, expiration date, billing and shipping address.
YOU REPRESENT AND WARRANT THAT YOU HAVE THE LEGAL RIGHT TO PLACE AN ORDER WITH THE USED PAYMENT METHOD.
You acknowledge and understand that we have an obligation treat all information provided to us in accordance with our Privacy Policy . By providing us with the right to share your information with third parties in order to complete transactions made by you or on your behalf through our Services. We may contact you if we need to verify your information prior to acceptance of any orders through our Services.
Taxes and Shipping Information
If any taxes apply to your order, they will be shown during the checkout process prior to finalizing your order. Shipping charges are billed separately, and will be shown during the checkout process prior to completing your order. We will do our best to deliver all orders on-time, as outlined in FAQ. However, we cannot guarantee that our shipping providers will not face any shipping delays or problems. Supacolor nor HeatPressNation shall not be liable for such delays or problems.
Order Issues
Our goal is to be as accurate as possible. However, we do not warrant that all descriptions, images, pricing or other information available through our Website is accurate, complete, updated, or mistake-free. IF YOU BELIEVE THAT YOUR ORDER DOES NOT MEET THE SPECIFICATIONS, WE ENCOURAGE YOU TO CONTACT US AT SUPPORT@HEATPRESSNATION.COM IMMEDIATELY SO THAT WE CAN ADDRESS THE ISSUE.
MISCELLEANOUS
Waivers and Disclaimers
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU HEREBY WAIVE ANY LEGAL OR EQUITABLE RIGHTS OR REMEDIES YOU HAVE OR MAY HAVE AGAINST US WITH RESPECT TO ANY ACTIVITIES, CONTENT, ACTIONS OR INACTIONS OF ANY THIRD PARTY IN CONNECTION WITH OUR SERVICES, INCLUDING WITHOUT LIMITATION, ANY ILLEGAL, DEFAMATORY, OFFENSIVE, OR UNAUTHORIZED CONDUCT BY ANY USERS.
OUR SERVICES ARE PROVIDED “AS IS,” “AS AVAILABLE,” AND WITH ALL FAULTS. WE CANNOT GUARANTEE CONTINUOUS OR SECURE ACCESS TO OR THAT OUR SERVICES WILL BE MISTAKE FREE OR THAT ALL TRANSACTIONS WILL BE COMPLETED. THE OPERATION OF OUR SERVICES MAY BE INTERFERED WITH BY NUMEROUS FACTORS OUTSIDE OF OUR CONTROL. TO THE EXTENT LEGALLY PERMITTED, WE DISCLAIM ALL EXPRESS AND IMPLIED WARRANTIES, TERMS AND CONDITIONS, INCLUDING, BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY, QUALITY OF INFORMATION, QUIET ENJOYMENT, NONINFRINGEMENT, TITLE, OR FITNESS FOR A PARTICULAR PURPOSE. YOU ASSUME ALL RISKS ASSOCIATED WITH YOUR USE OF OUR SERVICES.
Limitation of Liability
TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO EVENT WILL SUPACOLOR, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, OUR SERVICES, ANY SERVICES LINKED TO THEM, ANY CONTENT ON OUR SERVICES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.
THE FOREGOING DOES NOT AFFECT ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
Indemnification
You will indemnify and hold us (and our officers, directors, agents, subsidiaries, joint ventures and employees) harmless from and against any and all claims, demands, liabilities, damages, losses, fines, and expenses (including but not limited to, reasonable attorneys’ fees and other professional fees and costs of investigation) arising from or in any way related to: (1) your Content or use of our Services, including without limitation, your sale of any products; (2) your (or anyone using your account’s) breach of these Terms or any of our policies; or (3) your violation of any law or the rights of any third party, including without limitation, any intellectual property rights or privacy rights. You may not settle any claim in any manner that binds us without our express prior written consent. We may withhold any amounts due to you pending the resolution of any claim subject to this indemnity and may apply those amounts to the resolution of that claim.
Modifications
We reserve the right to modify or discontinue our Services, and to block or delete any information made available through our Services by any party, at any time without notice in our sole discretion. However, we do not have any obligation to update, maintain or correct any information made available through our Services.
We reserve the right, at any time and in our sole discretion, to change these Terms, FAQ and the Privacy Policy, in whole or in part. You are responsible for reviewing and complying with these Terms, FAQ and the Privacy Policy in effect at the time you use or access our Services. You acknowledge that you will be bound by the revised Terms, FAQ and the Privacy Policy , as of their effective date set forth therein, and your continued use of our Services constitutes acceptance of them.
Ganged Artwork
To print one transfer with multiple designs, or a single design needed in more than one size, select our SupaGang - 11.7" x 16.5" transfer type.
The Supagang option is only available in our Wearables, SubBlocker, and Soft Shell Blocker.transfers.
Customers will need to select the SupaGang - 11.7" x 16.5" sheet size to qualify for the ganged option. Choosing any other option will require a cancellation of the current order, and a new order will have to be replaced correctly. Also, Supagang artwork is required to be ganged prior to submitting your order.
Artwork Guidelines
Recommended Vector Files : AI, EPS
Recommended Raster Files: PNG, TIFF, PDF, PSD
300 dpi is required for all raster files.
Artwork must be submitted without a background color.
Vector redraw services are available if you do not have print quality artwork.
All artwork will be printed in CMYK. For any artwork submitted in RGB, colors are subject to change when converted to CMYK. Please note that this can change the overall look of your design.
Artwork with effects such as transparency, glows, fades, drop shadows, neon colors, or glitter are either subject to cancellation or will require artwork alterations to be able to be printed.
Your design cannot be larger than the sheet size you selected.
Production Time
Average production time is 2-4 business days. During periods of high production volume, please expect anywhere from 4-7 business days instead.
SupaColor orders will ship via Fedex 2-Day Air once completed.
Currently no other rush services are available.
Cancellation Policy
All customers understand that any order that does not have any activity after 5 business days of communication with a customer service representative at HeatPressNation is subject to cancellation. If the cancellation is processed before the customer responds, a virtual gift card will be issued for the amount of their order. A new order can be placed at any time using this gift card.
Additional Information
We do NOT recommend the Cricut Easy Press or any manual heat press for applying Supacolor transfers
Letting us know the color of your garment will ensure we produce this transfer perfectly for your garment. Incorrect garment information can lead to issues with your final printed transfers.
SupaColor is considered a custom product which makes it non-returnable product. See Supacolor Return Policy for more information.
